Welcome to TosDrive. By using our platform, you agree to the Terms & Conditions (“Terms”) below. Please read them carefully, as they form a binding agreement between you (“User”, “Guest”, “Host”) and TosDrive (“we”, “our”, “us”).

If you do not agree to these Terms, you must stop using the platform immediately.

1. Introduction

TosDrive is a peer-to-peer car rental marketplace. We connect vehicle owners (“Hosts”) with renters (“Guests”) through our mobile apps and website.

These Terms apply to:

      • TosDrive mobile applications (Android & iOS)

      • TosDrive website

      • All rentals, listings, payments, and communications on the platform

    By using TosDrive, you confirm you are at least 18 years old and legally able to enter into a contract.

    2. Definitions

        • Host: A user who lists a vehicle for rent.

        • Guest: A user who rents a vehicle.

        • Platform: TosDrive mobile apps & website.

        • Booking: A confirmed rental between a Host and Guest.

        • Vehicle: A car or transport asset listed on TosDrive.

      3. Account Registration

      To use TosDrive, you must create an account and provide accurate information.

      You must:

          • Be at least 18 years old

          • Provide a valid phone number & email

          • Provide accurate personal details

          • Agree to identity and driving license verification

          • Maintain only one TosDrive account

        We may suspend or delete accounts that violate these terms.

        4. Identity & Driving License Verification

        To ensure safety:

            • Guests must upload a valid driving license

            • Hosts must upload accurate vehicle documents

            • TosDrive may request additional verification

            • Failure to verify may result in account suspension

          You permit us to use identity data for verification and fraud prevention.
          Providing false documents is strictly prohibited.

          5. Vehicle Listings (Hosts)

          Hosts must ensure that:

              • Vehicle information is accurate and truthful

              • Photos represent the actual vehicle

              • The car is roadworthy, insured, and legally registered

              • The car is available at the listed times

              • Pricing is clearly stated

              • Any additional fees (delivery, fuel, late return penalties) are disclosed

            Hosts remain fully responsible for:

                • Maintenance of their vehicle

                • Roadworthiness

                • Any existing mechanical issues

                • Insurance coverage

              TosDrive may remove listings that violate policies.

              6. Booking & Rental Process

              A booking is confirmed when:

                  1. The Guest submits a booking request

                  1. The Host approves (or instant book applies)

                  1. Payment is successfully completed

                Both parties must follow TosDrive’s instructions for pickup, inspection, and return.

                7. Payments & Fees

                Payments are processed securely via ABA PayWay or other supported gateways.

                Guests agree to pay:

                    • Rental fee

                    • Delivery fee (if applicable)

                    • Fuel charges

                    • Damage fees, penalties, or fines

                    • Late return fees

                    • Cancellation fees (if applicable)

                  Hosts agree to:

                      • Accept payout schedules

                      • Pay TosDrive service fees & commissions

                      • Ensure pricing complies with local regulations

                    TosDrive may withhold funds temporarily in case of:

                        • Disputes

                        • Fraud investigation

                        • Chargeback risk

                      8. Guest Responsibilities

                      Guests must:

                          • Provide accurate identity and license information

                          • Inspect the vehicle before starting rental

                          • Return the vehicle in the same condition

                          • Follow traffic laws in Cambodia

                          • Not drive under influence of alcohol or drugs

                          • Not use the vehicle for illegal activities

                          • Not sub-rent or allow unauthorized drivers

                        Guests are financially responsible for:

                            • Damages

                            • Traffic fines

                            • Parking tickets

                            • Missing accessories

                            • Excess mileage (if Host specifies limits)

                          9. Host Responsibilities

                          Hosts must:

                              • Provide a safe, clean, and roadworthy vehicle

                              • Disclose all existing damage

                              • Provide valid documents

                              • Respond to bookings promptly

                              • Meet Guests on time for pickup & return

                              • Handle maintenance and repairs not caused by the Guest

                            10. Vehicle Inspection (Pickup & Return)

                            Before starting the rental:

                                • Host and Guest must take photos/videos

                                • Document existing scratches, dents, or issues

                                • Confirm fuel level

                                • Confirm mileage

                              The same steps must be repeated at return.
                              These records help resolve disputes fairly.

                              11. Damage, Accidents & Liability

                              If an accident occurs:

                                  • Guest must notify the Host immediately

                                  • Guest must report the incident to TosDrive

                                  • Guest may need to contact local authorities

                                  • Guest is responsible for damage unless caused by mechanical failure not due to misuse

                                TosDrive is not the owner of the vehicles and is not responsible for:

                                    • Vehicle condition

                                    • Insurance coverage

                                    • Accidents

                                    • Damages

                                    • Loss of property inside the vehicle

                                  Hosts and Guests are responsible for resolving issues according to the inspection record and local laws.

                                  12. Cancellations & Refunds

                                  Refunds depend on the Host’s cancellation policy and TosDrive rules.

                                  Guest cancellations may result in:

                                      • Full refund (early cancellation)

                                      • Partial refund (last-minute cancellation)

                                      • No refund (very close to pickup time)

                                    Host cancellations:

                                        • Guests receive 100% refund

                                        • Host may receive penalties for repeated cancellations

                                      TosDrive reserves the right to adjust policies for safety, fraud prevention, or disputes.

                                      13. Prohibited Activities

                                      Users may NOT:

                                          • Provide false information

                                          • Commit fraud

                                          • Harass or threaten other users

                                          • Circumvent the platform to avoid fees

                                          • Use the platform for illegal purposes

                                          • Upload harmful or malicious files

                                          • Damage TosDrive’s reputation or systems

                                        Violations may result in account termination.

                                        14. Platform Availability

                                        We try to keep TosDrive online 24/7, but we do not guarantee:

                                            • Continuous availability

                                            • Error-free operation

                                            • No interruptions

                                          We may perform maintenance, update systems, or temporarily suspend services.

                                          15. Intellectual Property

                                          All content on TosDrive:

                                              • Logos

                                              • Branding

                                              • App design

                                              • Website design

                                              • Text & images

                                              • Software and features

                                            Are owned by TosDrive and protected by copyright.

                                            Users may not copy, modify, or redistribute our content without permission.

                                            16. Disclaimers

                                            TosDrive is a marketplace, not a rental company.

                                            We are not responsible for:

                                                • Vehicle conditions

                                                • Damages

                                                • Mechanical failures

                                                • Accidents

                                                • Loss of personal items

                                                • Insurance disputes

                                                • Actions of Hosts or Guests

                                              Users enter rental agreements directly with each other.

                                              17. Limitation of Liability

                                              To the maximum extent permitted by Cambodian law, TosDrive is not liable for any:

                                                  • Injuries

                                                  • Damages

                                                  • Financial losses

                                                  • Vehicle losses

                                                  • Data breaches caused by third parties

                                                  • Legal claims between Hosts and Guests

                                                Your use of the platform is at your own risk.

                                                18. Account Suspension or Termination

                                                We may suspend or terminate accounts for:

                                                    • Fraud

                                                    • Abuse

                                                    • Violations of these Terms

                                                    • Illegal activities

                                                    • Unsafe behavior

                                                    • Multiple user complaints

                                                  Termination may result in loss of access to:

                                                      • Bookings

                                                      • Payouts

                                                      • Profile data

                                                      • Vehicle listings

                                                    19. Dispute Resolution

                                                    Disputes between Hosts and Guests should first be resolved through:

                                                        1. Pickup/return inspection photos

                                                        1. Chat discussions

                                                        1. Contacting TosDrive support

                                                      If unresolved, users must follow Cambodian law for legal resolution.

                                                      TosDrive may provide information supporting investigations or claims.

                                                      20. Changes to Terms

                                                      We may update these Terms at any time.
                                                      By continuing to use TosDrive after changes, you accept the updated Terms.

                                                      21. Governing Law

                                                      These Terms are governed by the laws of the Kingdom of Cambodia.

                                                      Any legal disputes must be resolved in Cambodian courts.
